If you believe you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room.
Telehealth is not a substitute for in-person care in all situations.

Arbitration and class action waiver notice

These Terms include a dispute resolution and arbitration section that affects your rights.
In most cases, disputes must be resolved by individual arbitration and not as a class action.

These Terms

These Terms and Conditions (Terms) govern your access to and use of this website and any pages where these Terms are posted (Website), plus any related online tools, portals, forms, messaging, scheduling, and payment features made available through the Website (Platform).

The Platform and certain administrative support functions may be provided using technology and operational support services from a third-party telehealth operations provider. If you access the Platform through a co-branded experience, embedded page, or link from another site, these Terms still apply.

By clicking “I Agree,” “Continue,” “Proceed,” “Register,” “Sign Up,” or a similar button, or by otherwise accessing or using the Website or Platform, you agree to these Terms and any policies referenced in these Terms.
If you do not agree, do not use the Website or Platform.

Definitions

For clarity, the following terms have specific meanings in these Terms.

Company, we, us, or our means Aura Telemed LLC.
You or your means the individual accessing or using the Website or Platform.
Clinician means an independent, licensed healthcare professional and or clinician group who may provide clinical services to you.
Third Parties means entities other than us, including Clinicians, pharmacies, laboratories, shipping carriers, payment processors, and technology providers.
Content means text, graphics, images, audio, video, documents, downloads, trademarks, logos, designs, software, and other materials made available through the Website or Platform.
User Content means information, text, images, videos, messages, documents, and other materials you submit through the Website or Platform.

Website content and informational use

The Website may include general information about services, telehealth concepts, wellness topics, conditions, or products. This information is provided for general informational purposes only.

We do not provide medical advice through the Website. Do not rely on Website content as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with questions you may have regarding a medical condition.

What we do and what we do not do

We provide technology and administrative services that help users access telehealth-enabled care and coordinate related non-clinical functions. This can include account creation, intake collection, scheduling support, customer support, payment processing, and communications tools.

We are not a medical group and we do not practice medicine. We do not provide diagnoses, treatment, or prescriptions.

Clinical services, if offered through the Platform, are provided by independent Clinicians. Clinicians are solely responsible for clinical decision-making, including whether telehealth is appropriate, what care to provide, and whether to prescribe medication.

Platform support and support contacts

The Platform may be powered, supported, and administered in whole or in part using technology and operational support services from Healthaide LLC, including for technical support, intake collection, scheduling support, communications tools, and payment processing.

Aura Telemed LLC provides general and non-clinical support for users, including help with account access, basic navigation, general questions about programs or services, and customer service issues that are not medical in nature.

Healthaide LLC provides medical support exclusively. Medical support means facilitating access to clinical services and helping route clinical questions through the Platform to independent licensed clinicians.

Healthaide LLC is not the patient’s treating clinician. Clinical services, if offered through the Platform, are provided by independent licensed clinicians and or clinician groups (Clinicians). Clinicians are solely responsible for clinical decision-making, including whether telehealth is appropriate, what care to provide, and whether to prescribe medication.

If you have a medical question, you should direct it to your Clinician through the Platform. If you are unsure how to contact your Clinician, contact Healthaide at support@healthaide.io for assistance routing your request.

Separate telehealth consent

To receive telehealth services, you may be required to review and accept a separate telehealth consent. That consent is incorporated into these Terms by reference.

Changes to the Website, Platform, and these Terms

We may update the Website, Platform, Content, and features from time to time, and we may suspend or discontinue any part of the Website or Platform at any time.

We may update these Terms from time to time. Changes are effective when posted on the Website or Platform. Your continued use after changes are posted means you accept the revised Terms.

Availability, eligibility, and verification

Services are not available in all states or jurisdictions. Availability can change due to clinical, operational, or legal requirements.

We may request proof of identity and location, and we may decline service if we cannot reasonably verify eligibility.

Account registration and security

Certain features require an account. You agree to provide accurate and complete information and to keep your login credentials confidential.

You are responsible for all activity under your account, including activity by anyone who uses your credentials.
You must notify us promptly if you suspect unauthorized access.

Electronic communications and e-sign consent

By using the Website or Platform, you consent to receive communications electronically, including by email, phone, SMS or text messages, in-app notifications, or secure messaging.

Communications may include service notices, account updates, reminders, required disclosures, follow-up requests, and instructions.

Message and data rates may apply. Message frequency varies. If SMS is offered, you may opt out by replying STOP, but opting out may limit your ability to receive important communications.

You agree that electronic signatures, acknowledgments, and records have the same legal effect as paper documents and handwritten signatures.

Not for emergencies

The Platform is not designed for emergencies and is not monitored for emergency messages.
If you have severe symptoms or believe you may be experiencing an emergency, call 911 immediately.

Privacy, health information, and security

Our collection, use, and disclosure of personal information is described in our Privacy Policy located on our website at aurarx.co.

Clinicians, medical groups, pharmacies, and labs may provide their own privacy notices or notices of privacy practices, which govern how they use and disclose protected health information.

We use reasonable safeguards designed to protect information, but no system is completely secure. You accept the risk of unauthorized access that may occur despite reasonable safeguards and agree to protect access to your devices, email accounts, and communication channels.

Governing law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules.

Dispute resolution and arbitration

Before starting a formal dispute, you agree to contact support and attempt to resolve the issue informally.

Except where prohibited by law, any dispute arising out of or relating to these Terms or the Website or Platform will be resolved by binding individual arbitration and not in a class, consolidated, or representative action.

Either party may bring an individual claim in small claims court if it qualifies.

Arbitration will be administered by a nationally recognized arbitration provider selected by the party initiating arbitration, under that provider’s applicable consumer arbitration rules. The arbitration will take place in Maryland, unless the parties agree otherwise or the arbitrator determines a different location is appropriate.

You and we waive the right to a jury trial.

You may opt out of arbitration by sending written notice within 30 days of first accepting these Terms. Your notice must include your name, the email address used for your account, and a statement that you are opting out of arbitration. Send the notice by email to Alex@aurarx.co.

If any part of this arbitration section is found unenforceable, the remaining parts will remain in effect.
